These Terms of Service (“Terms”) govern your access to and use of Fluent Thai (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing and using the Service, you accept and agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service (Public Beta)

Fluent Thai provides free online tools for learning and practicing the Thai language, including interactive applications for reading, listening, speaking, vocabulary, and related skills.

The Service may be offered as a public beta, meaning features may change, be removed, or behave unexpectedly. We do not guarantee that any feature, content, progress tracking, recommendations, or saved state will be available indefinitely.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

4. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains what information we collect and how we use it.

5. User Conduct / Acceptable Use

You agree to use the Service only for lawful purposes and in a way that does not:

  • Infringe on the rights of others
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service (including abuse, flooding, or denial-of-service)
  • Use bots, scrapers, or automated methods to access the Service in a manner that exceeds reasonable use or bypasses rate limits
  • Copy, download, scrape, harvest, or mirror substantial portions of the Service (including audio and content) without permission
  • Reverse engineer, decompile, or attempt to extract source code, datasets, or underlying content except to the extent prohibited by law
  • Bypass or attempt to bypass access controls or security features

6. Intellectual Property

The Service, including its content, audio, features, and functionality, is owned by Fluent Thai and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial learning purposes in accordance with these Terms.

You may not reproduce, distribute, publicly perform, publicly display, create derivative works from, or otherwise exploit the Service or its content without our written permission.

7. User Submissions (Feedback / Issue Reports)

If you submit feedback, bug reports, suggestions, or other content to us (collectively, “Submissions”), you grant Fluent Thai a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display those Submissions for the purpose of operating, improving, and promoting the Service.

Do not submit sensitive personal information in Submissions.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Fluent Thai disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or that content is accurate or complete. The Service is an educational tool and does not guarantee learning outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, Fluent Thai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising from your use of (or inability to use) the Service.

Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the fullest extent permitted by law.

10. Termination

We may terminate or suspend access to the Service immediately, without prior notice, if you breach these Terms or if we need to protect the Service, users, or our rights. We may also modify or discontinue the Service (in whole or in part) at any time.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the “Last updated” date at the top of this page when changes are made. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. You agree that any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
